Letzte Aktualisierung: July 2026

§ 1 Scope

These General Terms and Conditions (GTC) apply to all contracts, services and business relationships between altitude hub GmbH (hereinafter "Provider") and its clients (hereinafter "Client"), unless otherwise expressly agreed.

§ 2 Services of the Provider

The Provider provides consulting and services in the areas of artificial intelligence, digital transformation, web and app development, sports marketing, event conception, community building, as well as the operation of its own brands and ventures.

The specific scope of services results from the respective contract, offer or order confirmation. Side agreements or changes require written form.

§ 3 Conclusion of Contract

Offers from the Provider are non-binding. A contract is concluded when the Client accepts an offer from the Provider in writing, orally or by email, or the Provider confirms the order in writing.

§ 4 Prices and Payment Terms

All prices are in Swiss Francs (CHF), unless otherwise agreed. For consulting services, prices are understood as time-based fees unless agreed as a fixed price.

Invoices are due for payment within 30 days of the invoice date, unless a different period is stated on the invoice. In the event of late payment, the Client is in default without further reminder.

§ 5 Client Cooperation Obligations

The Client supports the Provider in fulfilling its tasks. The Client shall provide all necessary information, documents and access authorizations in a timely manner and shall name a competent contact person.

Delays caused by cooperation services not rendered or rendered late by the Client are at the Client's expense and may lead to corresponding schedule delays and additional costs.

§ 6 Deadlines and Time Limits

Deadlines and time limits are only binding if expressly agreed as such. The Provider is not in default insofar as it is prevented from performing due to circumstances for which it is not responsible.

§ 7 Warranty

The Provider provides its services with the care of a diligent professional. Defects must be reported by the Client without delay, but no later than 14 days after the respective service has been rendered, in writing.

The warranty is provided at the Provider's discretion by remediation or re-performance of the service. Excluded are defects caused by the Client or attributable to incorrect information provided by the Client.

§ 8 Liability

The Provider is fully liable for damages caused by intent or gross negligence of its auxiliary persons or fulfillment agents.

For slight negligence, the Provider is only liable in the event of a breach of essential contractual obligations and only for typical and foreseeable damages. Liability for indirect damages, consequential damages and lost profits is excluded.

§ 9 Confidentiality

The contracting parties undertake to treat all confidential information and trade secrets of the other party that become known in the course of the business relationship as confidential. This obligation continues beyond the termination of the contractual relationship.

§ 10 Intellectual Property and Usage Rights

All works, concepts, developments and intellectual property rights created in the course of providing the service remain with the Provider until full payment. Upon full payment, the contractually agreed usage rights are transferred to the Client, unless otherwise expressly agreed.

§ 11 Contract Duration and Termination

Unless a specific term has been agreed, continuous obligations may be terminated by either party in writing with a notice period of 30 days to the end of a calendar month.

The right to extraordinary termination for good cause remains unaffected.

§ 12 Final Provisions

Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose.

Swiss law applies exclusively to all contractual relationships. Exclusive place of jurisdiction is Pontresina, Switzerland.
